Win a Year of Free Culver’s Custard!

The following rules apply to the Fav Flavor Facebook Giveaway (“Giveaway”) presented by Landmark Credit Union (“Landmark”).  

By entering this Giveaway, you agree to these Official Rules and should carefully read them before entering. The promotional sponsors of this Giveaway are Landmark Credit Union, 555 South Executive Drive, Brookfield, WI 53005 and Culver Franchising System, LLC (“CFS”), 1240 Water Street, Prairie du Sac, WI 53578. The Giveaway is in no way sponsored, endorsed, administered by, or associated with Meta, Facebook, Instagram or any other social media channel. 

Giveaway Description & Eligibility: NO PURCHASE / PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. One (1) winner will receive fifty-two (52) paper coupons for one (1) free scoop of frozen custard, redeemable at any CFS owned or franchised Culver’s restaurant with a value of $156.00 (the “Prize”).  

The Giveaway is open to residents of the fifty (50) United States and the District of Columbia who are at least 21 years or over as of July 20, 2025. Employees of Landmark, CFS, their affiliates, subsidiaries and divisions and their immediate family members (defined as parents, spouses, children, siblings, grandparents and their respective spouses), or persons living in the same household are not eligible. Void where prohibited by law. By submitting an entry, entrants agree to these Official Rules. 

PURCHASE DOES NOT IMPROVE AN INDIVIDUAL'S CHANCES OF WINNING. The odds of being selected as a Giveaway winner will depend on the total number of eligible entries received. Only one entry per person. 

How to Enter: You will be entered into the Giveaway when you submit an entry either by: a) by commenting your favorite Culver’s custard flavor in Landmark’s Fav Flavor Giveaway Facebook post; b) entering on Landmark’s website on the Fav Flavor Giveaway entry form at landmarkcu.com/fav-flavor-giveaway; or c) mailing a 3” x 5” card containing your name and address to Landmark Credit Union, Attn: Fav Flavor Giveaway, P.O. Box 510870, New Berlin, WI 53151. When entering on our website or by mail, a mailing address is required and will be used to mail the Prize to the winner. Entries received via Landmark’s website or mail that do not contain an address will not be considered qualified entries. Providing your phone number and email are optional and will only be used to notify you if you win, unless you chose to opt in to receiving marketing communications from Landmark when submitting your entry. If entering by commenting on our Facebook post, Landmark will contact the winner via private Facebook message, at which time the winner will be required to provide a mailing address for delivery of the Prize.  

Entrants may enter only by using the entry methods described in these rules. Use of any device, code, or other means to automate entry is prohibited. Winners will be selected by Landmark by a randomized selection from among all qualified entries. In order to be entered to win, entries must be received between 7:00 a.m. Central Time on July 20, 2025, and 11:59 p.m. Central Time on July 31, 2025 (the “Giveaway Period”). Landmark’s computer is the official timekeeping device for the Giveaway. The prize drawing will be held on August 1, 2025. If a selected winner is ineligible, the Prize will be awarded to an alternate winner selected by another randomized selection from all remaining eligible entries. Prize is non-transferable. Winners are responsible for all taxes on prizes and expenses, including, without limitation, federal, state, and local sales, income taxes, luxury taxes, and any other costs incurred in claiming or using the Prize. By accepting the Prize, Prizewinners agrees to provide Landmark with their Social Security number or taxpayer identification number as required for tax purposes. If the Prizewinner's winnings exceed $600 in a calendar year, Landmark will issue a Form 1099-MISC to the IRS and Prizewinner. No Prize substitutions or cash equivalent of a Prize is permitted. 

Contacting Winners: Prizewinner will have the Prize mailed to them at the address provided in their entry or, if the Prizewinner entered via Facebook comment, at the address provided to Landmark via private Facebook message. If the Prize winner submitted their entry via Facebook comments and fails to respond within forty-eight (48) hours to Landmark’s private message requesting a mailing address to deliver the Prize, the Prize will be forfeited and a new winner will be chosen from the remaining eligible entries. If the Prize is returned to Landmark for any reason, the Prize will be forfeited, and a new winner will be chosen from the remaining eligible entries.  

General Conditions: Entrants agree to abide by the terms of these Official Rules and by the decisions of Landmark, which are final and binding on all matters pertaining to the Giveaway. All federal, state, and local laws and regulations apply. Entrants grant to Landmark the right to use and publish their proper name and location of residence online, in print, and in any other media in connection with the Giveaway. By submitting an entry, you are granting Landmark with a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, display, adapt, and modify any and all User-Generated Content in any format across our platforms, including our website, social media pages, and marketing materials. You represent to Landmark that you are the sole owner of your User-Generated Content, that it does not infringe on the rights of any third-party, and you have obtained any and all necessary consents from individuals appearing in your User-Generated Content. For purposes of these Official Rules, User-Generated Content means any and all information, comments, posts, photos, images, and other content or information that you provide or submit to Landmark in connection with your entering the Giveaway. 

By entering, participants agree to release and hold harmless Landmark, their subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability or any injuries, loss, or damage of any kind arising from or in connection with this Giveaway, the use of User-Generated Content or any Prize won. Landmark reserves the right to terminate the Giveaway at any time without notice. If Landmark determines, in its sole discretion, that there is any suspected or actual electronic tampering with the Giveaway or if technical difficulties compromise the integrity of the Giveaway, Landmark reserves the right to void the entries at issue and/or suspend, modify, or terminate the Giveaway. 

Landmark is not responsible for the printing of or typographical errors in any Giveaway-related materials; for stolen, lost, late, misdirected, damaged, incomplete, or illegible entries; or for transactions that are processed late or incorrectly or are lost due to computer or electronic malfunction. Landmark reserves the right to cancel or modify the Giveaway if fraud or technical failures compromise the integrity of the Giveaway as determined by Giveaway in its sole discretion. 

Dispute Resolution and Limitation of Liability: 

This Giveaway is conducted in English. Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrant, Landmark and CFS in connection with this Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Wisconsin, without giving effect to any choice of law or conflict of law rules (whether of the State of Wisconsin, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than in the State of Wisconsin. 

BY ENTERING THE GIVEAWAY, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE GIVEAWAY, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), NOT TO EXCEED FIFTY DOLLARS ($50.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED FIFTY DOLLARS ($50.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY THIS LIMITATION OF LIABILITY SHALL NOT APPLY IN SUCH JURISDICTIONS.  

PRIVACY & PERSONAL INFORMATION: Entrants are not required to opt-in to receive further communications from Landmark in order to participate in the Giveaway and opting in will not increase your chances of winning. Personal information collected from entrants will be used by Landmark for the purpose of administering the Giveaway only. Landmark will not sell, share or otherwise disclose entrant’s personal information third parties, other than to third parties engaged by Landmark to administer the Giveaway. In the event of any discrepancy between Landmark’s Privacy Policy and these Official Rules, the Privacy Policy will control. Cancellation: If for any reason beyond the control of Landmark, the Giveaway is unable to be held, or if Landmark’s sole discretion, there is any suspected or actual evidence of any cause or condition affecting the Giveaway’s operability, fairness, integrity, or accuracy, Landmark reserves the right to modify, suspend, terminate or cancel the Giveaway without notice. 

Winner’s List: To request the names of the Giveaway winners, send a self-addressed postage-stamped envelope to: Landmark Credit Union, Attn: Fav Flavor Giveaway Winner, P.O. Box 510870, New Berlin, WI 53151-0870. Requests must be received by September 17, 2025.
